1. Agreement to Terms

Welcome to LeadWebia ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website and services (the "Service"). By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Description of Service

LeadWebia is a software-as-a-service platform that enables users to find and analyze publicly available data about local businesses ("Leads"). Our service indexes, analyzes, and aggregates publicly available data from third-party sources, such as Google Maps. You acknowledge that we do not own this third-party data and cannot guarantee its accuracy, completeness, or timeliness. The data is provided for informational purposes only.

3. Use of Service

LeadWebia provides tools to discover and analyze business information. You agree to use the service only for lawful purposes and in accordance with these Terms. You are responsible for maintaining the confidentiality of your account credentials.

4. User Responsibility & Compliance

Important: You acknowledge and agree that you are the sole responsible party for complying with all applicable laws and regulations regarding unsolicited communication and data privacy, including but not limited to the ePrivacy Directive (EU), GDPR (EU), CAN-SPAM Act (USA), and any other local anti-spam laws.

LeadWebia provides publicly available data for informational purposes. We do not authorize or encourage the use of this data for spamming or any illegal marketing activities. It is your strict responsibility to ensure you have the necessary legal basis (such as consent or legitimate interest) before contacting any lead found through our service.

Indemnification: You agree to indemnify, defend, and hold harmless LeadWebia from any claims, damages, liabilities, costs, or fines (including legal fees) arising from your misuse of the data, violation of these Terms, or non-compliance with any applicable anti-spam or data privacy laws.

5. User Accounts

You must be at least 18 years old to create an account. You are responsible for safeguarding your account information, including your password, and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

6. Subscriptions, Payments, and Credits

Our Service is billed on a subscription basis. You will be billed in advance on a recurring, monthly basis according to the plan you select.

  • Credits: Your subscription plan includes a specific number of "Credits" allocated to your account at the start of each billing cycle. Credits are used to perform actions within the Service, such as saving new leads. Credits are valid for one billing cycle only. At the start of each new billing period, your credit balance is reset to the amount included in your plan. Unused credits do not roll over to the next cycle and are forfeited.
  • Upgrades: If you upgrade to a higher-tier plan, you will be billed for the new plan, and the corresponding credits will be added to your existing credit balance immediately upon successful payment.
  • Billing: All payments are handled by our third-party payment processor, Stripe. By subscribing, you agree to their terms of service.
  • Cancellation: You may cancel your subscription at any time through your account settings. The cancellation of your recurring billing is effective immediately. After cancellation, you will retain full access to the Service and may continue to use any remaining credits in your account until your balance is depleted. No new credits will be added to your account, and no refunds will be provided upon cancellation.
  • Refund Policy: You may request a refund only if you have not used any of the credits included in your subscription plan. If you wish to request a refund under these conditions, please contact us at hello@leadwebia.com. Refunds are not available once any credits have been consumed. By using a credit, you acknowledge that the service has been fully performed regarding that credit and you waive your right to a cooling-off period or withdrawal regarding the consumed portion of the service.

7. Acceptable Use Policy

You agree not to misuse the Service or the data it provides. Prohibited activities include:

  • Reselling, sublicensing, or otherwise distributing the raw data obtained from our Service in bulk.
  • Using the Service for any illegal purpose or in violation of any local, state, national, or international law.
  • Attempting to reverse-engineer, decompile, or otherwise discover the source code of our application or scraping technology.
  • Using automated systems or software to extract data from our Service in a way that is not explicitly permitted via an official API.

8. Intellectual Property

The Service itself, including its original content (excluding third-party data), features, and functionality, are and will remain the exclusive property of LeadWebia. Our trademarks may not be used in connection with any product or service without our prior written consent.

9. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will cease immediately.

10. Limitation of Liability

In no event shall LeadWebia be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service or any data provided therein. Our total liability for any claim arising from these Terms or the Service will not exceed the amount you paid us in the 12 months preceding the claim.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of any material changes by notifying you via email or through the Service. By continuing to use the Service after revisions become effective, you agree to be bound by the revised terms.
